The Punjab & Haryana High Court has recently put a temporary stay till the next date of hearing which is December 14, 2020 on the proceedings in a fraud and criminal conspiracy FIR lodged against the founder of Oyo Hotels & Homes Private Limited (OHHPL) and it’s senior functionaries of OYO’s Weddingz.in team at the Dera Bassi police station.
Bipan Ghai, a Senior Advocate and Counsel for victim Vikas Gupta said, “In a bid to mislead the media, public & its investors, Oyo has been pushing wrong information to the media, with a malafide intention. Oyo is trying to make the ‘temporary’ stay look like a ‘permanent’. An FIR has been registered against the accused for fraud and conspiracy. The Honourable High Court has ordered a ‘proceeding stay’ till next date only and we have to submit a reply as well to clear all aspects and nail the lies being deviously projected by Oyo to mislead the court.”
The complainant against Oyo Vikas Gupta and his legal team have refuted point by point this and all other false claims made by Oyo in a section of the media.
Vikas Gupta said, “I am not the only business associate of Oyo who they have victimised. There are many across India with whom this company has played a fraud, and I have details of these victims. I demand a CBI inquiry against Oyo for propagating scams across India.” Gupta added, “The top management of Oyo, fearing arrest in the FIR filed against them; are resorting to misleading tactics and blaming police and calling the FIR frivolous. I will put another complaint against them as per law soon. ”
It is to be noted that Oyo has been indicted in a thorough inquiry by Mohali police for being involved in criminal conspiracy and fraud in relation to a business agreement signed by the company with Vikas Gupta who owns Vikas Mineral Foods Private Limited (VMFPL), under which Oyo was running a marriage palace belonging to Gupta on a lease basis with their brand namely Weddingz.in Banquet Zirakpur.
Ghai added, “The accused are trying to confuse everyone by branding as a ‘civil matter’ a purely criminal issue, after all an FIR has been registered against them.”
Ghai further stated , “The talk of connivance with police is vehemently denied by us. The Mohali police carried out an independent, thorough and professional investigation for 4 months before lodging the FIR. The SP (Rural) Mohali submitted its report which indicted all the top management of Oyo, & after this the report was sent to the DA legal who gave the opinion. Only after the DA legal gave consent to register the case did the SSP Mohali order installation of the case. The police had called the accused many times but no senior official joined the investigation when the police were investigating the matter before lodging of FIR.”
Vikas Gupta stated, “Despite terminating the agreement in a one-sided way and in a manner which smacks of ‘criminal intent’, my marriage palace’s name was used and innocent people were cheated of money by booking marriages in April 2020 and there is proof that weddings have been booked till Dec 2020 after termination on 31st March 2020 by them with wrongful intentions. This is clearly a criminal conduct.”
“If they are as clean as they are claiming then why are they running from the police investigation?” questioned Vikas Gupta. Gupta further said, “I have full faith in the judicial system and am sure that I will get justice in the matter.”

Notably several Hotel Associations including The Federation of Hotel and Restaurant Associations of India (FHRAI) have boycotted Oyo alleging from their side and for causing huge losses to their members hotels .
