Mohali Municipal Corporation dumps garbage on disputed site
The Municipal Corporation, Mohali (MCM) has started dumping the city garbage full of truckloads, containing polythene bags, human waste, dead animals etc., in the dumping ground, adjoining the PSIEC housing complex, Phase 8-B, Industrial Focal Point, Mohali. Meanwhile, the Punjab & Haryana High Court has directed the Commissioner, MCM to remain present on 15th April, 2020 in the court during the hearing in the matter relating to shifting of the dumping site from Mohali to other place.
This illegal dumping by Municipal Corporation resulted into decomposition and was emitting foul smell and the mosquitoes breading in slush all around the area has made the lives miserable for the residents of housing complex. The distance from the housing complex to this dumping site is hardly 50 meters.
Mr Satwant Singh Rangi, Advocate, counsel of the petitioner Society, said, “The Society as well as its members and even the gram panchayat of village Chappar Chiri Kalan and Chappar Chiri Khurd and Kailon has requested the concerned government authorities many times raising their grievance against the said dumping ground with a request to shift the same from the present residential area to some other suitable place, but when the authorities failed to take any action, the petitioner Society filed a PIL in Hon’ble Punjab and Haryana High Court on 12 April, 2006, which remained pending for many years and during pendency of writ petition number of times, effective orders passed by the High Court and many senior officers were called.”
Ultimately, Mr Suresh Kumar, Principal Secretary to Government, Department of Local Government of Punjab, Chandigarh, had submitted affidavit on 01 May 2012, in which he undertakes in para 2 of his affidavit about the time schedule for setting up the solid waste management facility at village Samgauli within 16 months. That the matter came up for hearing on 28 February 2020 and counsel for the petitioner Mr Rangi argued that till date, nothing concrete was done by the State government and regular dumping of city garbage at the site resulted into a mountain of garbage.
The lives of the members of petitioner Society and nearby residents became hell due to continuous emanating of foul smell from the dumping site and the Municipal Corporation is not taking any precautionary measures in terms of the guidelines of National Green Tribunal (NGT) and Pollution Control Board.

After considering the arguments of Mr Rangi, the Division Bench of the HC issued directions to the Commissioner, MCM to remain present in the Court on 15th April 2020.
