It has come to the notice of Chandigarh Housing Board that a number of cases are kept pending to the want of responses to the letters written by CHB to the various government organizations, banks and previous employers. For instance, in case of any old pending vigilance enquiries, regarding which there is no information of closure, NOC regarding loans from banks or the employers of the allottee etc. the Board cannot move forward and process the case for transfer of property as no response is received despite several letters and reminders written to them.
Keeping in view the above, in the interest of public service and to mitigate the hardships faced by the allottees/applicants in such matters, it has been decided that :-
- i)In case of a response, that is awaited, regarding the outcome/status of a vigilance enquiry, chb shall rely on the affidavits and documents submitted by an allottee/applicant and in addition take an indemnity bond stating clearly that either, according to the knowledge and belief of the allottee/applicant the said vigilance enquiry has ended or in case if he/she is not aware of the same, then in that case he/she shall be bound by the outcome of the same and the case may be processed subject to the outcome of the said enquiry and the liability of the said outcome shall rest squarely on the shoulders of the allottee/applicant.
- The allottee/applicant shall further indemnify the Board for any loss or damage suffered due to the pendency or outcome of such vigilance enquiry. The said allottee/applicant shall also submit an affidavit to this effect. In any case, even at present as per the documents being executed by the applicants, the Board reserves the right to cancel the transfer/allotment of the dwelling unit in question in case of any false statement or fraudulent means used for the same. To safeguard the rights of any future purchaser of such property while issuing the transfer letter it may be mentioned that the transfer has been made subject to the outcome of enquiry, if any.
- ii)In case where an noc is awaited in cases where loans had been raised from banks or from their employers in case of government employees, chb will write a letter to the concerned bank enquiring about such noc/ status of loans/ mortgages, clearly stating in the letter that in case no reply is received within 15 days from the issue of the letter, the board shall transfer the property in favour of the applicant. In case of a loan/ house building advance taken by any government employee no such letter shall be written to the employer/ organization and the case shall be processed on the basis of the statements made by the allottee/ applicant in the documents submitted to the board. Additionally, a special indemnity bond shall be taken from such allottee/applicants, clearly stating that according to the knowledge and belief of the allottee/applicant the said loan has been paid off or in case if he/she is not aware of the same than in that case he/she shall be bound to pay back the same to the concerned bank or employers as the case may be, if found due in future. The case shall be processed accordingly. The allottee/applicant shall further indemnify the board for any loss or damage suffered due to the same. The said allottee/applicant shall also submit an affidavit to this effect.
